Arushi case: Rajkumar, Krishna granted bail

The Ghaziabad sessions court on Friday granted bail to Rajkumar and Krishna, main accused in the Noida twin murder case, on two sureties of Rs 25,000 each. The duo will now walk free.

The CBI has till September 13 to file charge sheets against all the accused. This is however unlikely to happen as the investigating body has no material evidence against the accused.

While Rajkumar's counsel contended that there was no evidence against his client, the CBI informed the court that it had telephonic records suggesting that the accused was constantly in touch with Hemraj, the murdered domestic help of the Talwars.

Krishna was the compounder of Dr Rajesh Talwar, father of Arushi, was also granted bail after it was moved in the designated CBI court by his counsel R K Anand and F C Sharma.

Last week, Vijay Mandal, another prime accused in the case, had also got bail after the central investigating agency cited lack of evidence.

With Krishna getting bail, he is the last accused to be released thereby putting a question mark on the investigation into the sensational double murder case.

Earlier on Friday, the CBI opposed his bail application, saying investigations against him were continuing.

The bail application of another accused Krishna, compounder of Dr Rajesh Talwar, father of slain teenager Arushi, was also moved in the designated CBI court by his counsel R K Anand and F C Sharma.

The arguments on this application would be heard in the afternoon.

While Rajkumar's counsel contended that there was no evidence against his client, the CBI informed the court that it had telephonic records suggesting that the accused was constantly in touch with Hemraj, the murdered domestic help of the Talwars.

Both Aarushi and Hemraj were killed on the intervening night of May 15-16.

The case was transferred to the CBI on May 31. The CBI also said that since Rajkumar, arrested on June 27, was a Nepalese citizen, he could manage to flee the country and also try to destroy evidence against him if released on bail.

CBI framing Krishna, Rajkumar

The families of Krishna, medical assistant of Dr Rajesh Talwar, and Rajkumar, the domestic help of the Duranis both accused in the murders of Arushi and Hemraj have alleged that the CBI is framing the duo.
Allurements offered
Family members of the two accused alleged that initially the CBI lured them with money in return of 'help'. They claimed that they were offered a flat and car for their 'cooperation'.
When we refused to cooperate the officials of the investigating agency threatened us that Krishna and Rajkumar would be pushed from the terrace and it would be made to look as if they were killed while trying to escape.
Being framed
Talking to the media, along with leaders of the Nepali community in the city, the family members alleged that the CBI is cooking up stories and have "chosen the characters". They claimed that in its bid to save the skin of Dr Rajesh Talwar, the CBI is framing the "poor".
Their family also alleged that the CBI had forced and threatened Krishna to take the name of Rajkumar and Vijay Mandal.
Moreover, during the interrogation and before the narco test they were physically tortured and were not allowed to sleep.
Decent Rakjumar
Rajkumar's cousin Dev Hari Gautam who is in Delhi since he heard about him, said, "I know him since childhood. He cannot even kill a hen. When I came here and met his owner Prafull and Anita Durani, they assured me that Rajkumar has nothing to do with the case and he was called for interrogation only. They also told me that he was at home when Arushi and Hemraj were murdered.
"Gautam added, "Anita Durani told me that my brother was very decent. If he had any bad feeling for Arushi then why would I have kept him at my home. Even my daughter is as old as Arushi."
Mohan, brother of Krishna said, "Krishna was taken to Talwar's residence and was asked to sleep there, walk bare foot and open the doors. He was also asked to hold the glass full of beer and drink it."
Latest meeting
"In my latest meeting with Krishna, he had told me that the CBI officers were asking him to say that he had given weapon of crime to Sujata. Krishna or any one from my family doesn't know any one called Sujata. My brother is innocent," he added.
Fight against CBI
Krishna's family demanded clear explanations from the CBI. The families of the accused also said that they would collectively fight against the CBI.
They questioned, if the CBI knows every thing about the murder then why they have failed to recover mobile of Arushi and Hemraj. IT also failed to find out the weapon of crime.
If Krishna and Rajkumar were the killers, they could easily throw away their clothes if they can throw the weapon and mobile phones, the families said.
Krishna's family also said that they will ask Nepal MEA to step in and ask lawyers from Nepal to come to India to fight their case.
